It can sometimes be unclear what a temp agency must provide in order to use Oribi WorkpassID. In this article you can read about the characteristics of a temp agency and which data you must submit for assessment by Oribi.
Characteristics
A temp agency makes employees available to work under the direction and supervision of the hirer. Usually there is an agreement about this on an hourly or piece-rate basis.
Documents from the temp agency
Submit the following company documents:
KvK (Dutch Chamber of Commerce) registration
Waadi (Dutch Placement of Personnel by Intermediaries Act) registration (listing with the KvK for temporary staffing)
G-rekening (blocked account for wage tax/VAT) agreement
Verklaring betalingsgedrag (statement of payment conduct)
SNA (Stichting Normering Arbeid) register (recommended)
Personal data/documents for an employee from the EU/EEA
Also submit the data of your workers. For workers from the EU/EEA, submit the following:
Name, address and place of residence
Type of identity document, document number and expiry date (please note, no copy!)
BSN (Dutch citizen service number)
The employee can also submit this data themselves via My WorkpassID, if the subcontractor chooses this option.
Personal data/documents for an employee from outside the EU/EEA
For employees from outside the EU/EEA, submit the following additional data:
Copy of passport (except for Turks / Turkey has a treaty with the EU/EEA)
Residence permit
Work permit
In the case of a foreign employer: foreign permits
Special attention
The same rules apply to foreign temp agencies as to Dutch temp agencies. Foreign employees who are posted are in principle always liable to pay tax in the Netherlands. Ask for the employees' A1 certificates (EU social-security coverage).
